Article 1 — Purpose and acceptance
These terms of use (the "Professional Terms") govern the relationship between Therago and any professional — psychologist or wellness practitioner — who creates an account on the Therago platform (the "Platform") in order to present their practice and receive bookings (the "Therapist"). Acceptance of these Professional Terms, recorded at sign-up, is a condition of access to the services.
Article 2 — Registration requirements
The Therapist warrants, at sign-up and throughout their use of the Platform:
- the accuracy, completeness and timeliness of the information provided (identity, contact details, INAMI/RIZIV or ComPsy number where applicable, diplomas, fees, consultation addresses);
- that they actually hold the qualifications, diplomas and titles mentioned on their profile;
- that they are entitled to practise their activity in Belgium and, for regulated professions, hold the accreditations, licences or registrations required by the applicable legislation.
Therago reserves the right to refuse or suspend any registration that is incomplete, inaccurate or contrary to these Professional Terms.
Article 3 — Professional liability and insurance
The Therapist practises entirely independently. They are solely responsible for the care and services they provide, for their compliance with the laws, regulations and ethical rules applicable to their profession, and for the information they communicate to patients. The Therapist declares that they are covered by professional liability insurance appropriate to their activity and undertakes to keep it in force for the entire duration of their registration. Therago assumes no liability whatsoever for the care services.
Upon registration, and at the latest before their public page is published, the Therapist declares: that they carry out their activity in compliance with the laws applicable to it; that they make no medical diagnosis; that they promise no cure and no result; that they never encourage anyone to interrupt ongoing medical treatment; and that they refer the person to a healthcare professional whenever their situation calls for it. This declaration is time-stamped and kept together with the version of the text accepted. The Therapist undertakes that the content of their profile — presentation, declared trainings, scope of practice, frequently asked questions, services and prices — remains consistent with that declaration, and in particular contains no promise of result or cure, nor any accreditation they do not hold. Therago grants no accreditation or label, does not select Therapists on the quality of their practice and recommends none of them.
Article 4 — Data protection: roles and processing on behalf (Art. 28 GDPR)
For the personal data of their patients that they process in the course of their activity (records, notes, follow-up), the Therapist acts as a data controllerwithin the meaning of the GDPR. For the data processed through the Platform on the Therapist's behalf (patients' contact details, appointments, reminders), Therago acts as a processor within the meaning of Article 28 GDPR. This article constitutes the data processing agreement between the Therapist and Therago:
- Subject matter, nature and purpose of the processing: hosting and management of appointments, patients' contact details and related communications (confirmations, reminders by email or SMS), solely for the purpose of providing the Platform's services.
- Duration:the processing lasts as long as the Therapist's account is active, and until the deletion or return of the data provided for below.
- Categories of data and data subjects:patients' identification and contact data, appointment data (practitioner consulted, date, time, location or video); the data subjects are the Therapist's patients.
- Instructions: Therago processes this data only on the documented instructions of the Therapist, as recorded in these Professional Terms and in the Platform settings.
- Security: Therago implements appropriate technical and organisational measures (encryption in transit, access control, logging) and ensures that persons authorised to process the data are bound by an obligation of confidentiality.
- Sub-processing: the Therapist gives general authorisation for Therago to engage sub-processors, in particular the hosting provider (Microsoft Azure, EU region), Stripe (payments and identity verification) and messaging service providers (email, SMS). Therago informs the Therapist of any intended change concerning these sub-processors, giving the Therapist the opportunity to object, and imposes on them obligations equivalent to those set out herein.
- Assistance:taking into account the nature of the processing, Therago assists the Therapist, insofar as possible, in responding to requests to exercise data subjects' rights and in complying with their obligations regarding security, notification of data breaches and, where applicable, data protection impact assessments.
- End of contract:upon closure of the account, Therago deletes or returns to the Therapist, at the Therapist's choice, the personal data processed on their behalf, and destroys existing copies, unless legally required to retain them.
- Audit: Therago makes available to the Therapist the information necessary to demonstrate compliance with this article and allows for audits, under reasonable conditions agreed between the parties.
Article 5 — Subscriptions, billing and termination
Access to certain features of the Platform is subject to a paid subscription, according to the rates and plans in force displayed on the Platform at the time of subscription. Subscriptions are invoiced in advance per period (monthly or annually depending on the plan) and renewed automatically. The Therapist may cancel their subscription at any time, with effect at the end of the current period; amounts already invoiced remain due. Therago may change its rates subject to reasonable notice given before the next renewal.
Article 6 — Suspension and exclusion
Therago may suspend or delete a Therapist's account, after formal notice except in cases of urgency or particular seriousness, in the event of (a) abusive or fraudulent use of the Platform, (b) false information provided at sign-up or on the profile, (c) a serious complaint from a patient or an authority, (d) a breach of these Professional Terms, or (e) non-payment of the subscription. Suspension or deletion of the account does not give rise to any compensation, without prejudice to the pro-rata refund of the unused subscription period in the event of a deletion not attributable to the Therapist.
Article 7 — Intellectual property
The Therapist retains all rights to the content they publish on their profile (texts, photographs, documents). They grant Therago a non-exclusive, worldwide, royalty-free licence to display, reproduce and technically adapt this content, solely for the purposes of operating and promoting the Platform, for the duration of their registration. The Therapist warrants that this content does not infringe the rights of third parties. The Platform, its trademark, its design and its code remain the exclusive property of Therago.
Article 8 — Changes to the Professional Terms
Therago may amend these Professional Terms at any time. Substantial changes are notified to the Therapist with reasonable notice; continued use of the Platform after they take effect constitutes acceptance.
Article 9 — Governing law and jurisdiction
These Professional Terms are governed by Belgian law. Any dispute relating to their validity, interpretation or performance falls within the exclusive jurisdiction of the courts of the judicial district of Walloon Brabant.
