Terms of Use — Patients

Article 1 — Purpose and acceptance

These terms of use (the "Terms") govern the use of the Therago platform (the "Platform"), accessible at therago.be, by any person wishing to search for a therapist, view a profile or book an appointment (the "Patient"). By using the Platform or making a booking, you acknowledge that you have read these Terms and accept them without reservation. If you do not accept the Terms, you must refrain from using the Platform.

Article 2 — Therago's role: technical intermediary

Therago is exclusively a technical service that connects patients with independent professionals (psychologists and wellness practitioners, the "Therapists") and enables appointment booking. Therago is neither a healthcare provider, nor a care facility, nor an emergency medical service. Therago does not provide any medical, psychological or therapeutic advice, does not make diagnoses and does not recommend any treatment.

Each Therapist works in their own name and under their sole responsibility: their qualifications, their insurance, their tax and social obligations, as well as the content and conduct of their sessions, are theirs alone. The content displayed on profiles is supplied by the Therapists themselves; Therago hosts it as a technical intermediary, without prior control over its substance.

Article 3 — Care relationship

Any care or support agreement concluded following a connection made through the Platform binds exclusively the Patient and the Therapist. Therago is not a party to that relationship and does not intervene in the content, the conduct or the invoicing of the care services. The choice of a Therapist is solely the Patient's decision.

Article 4 — No guarantee as to the quality of care; "Verified professional" badges

Therago does not guarantee or verify the quality, relevance or outcome of the services provided by Therapists. The "Verified professional" badge displayed on certain profiles attests only that: (a) the INAMI/RIZIV number or the ComPsy (Belgian Psychologists Commission) licence number provided by the Therapist was found in the corresponding public register, and/or (b) the Therapist's identity was verified using the Stripe Identity service. This badge in no way constitutes a guarantee of competence, quality of care or results, nor a recommendation by Therago.

Article 5 — Unregulated practices

Some wellness practices listed on the Platform are not regulated in Belgium (no protected title, no mandatory training, no public oversight). Patients are invited to verify for themselves the qualifications, experience and methods of the practitioner before any consultation, and to consult a physician for any health problem.

Article 6 — Content published by Therapists; reporting

Diplomas, certificates, attestations and other documents displayed on a Therapist's profile are provided by the Therapist under their sole responsibility. The same applies to all the content of their profile: presentation, declared trainings, scope of practice, frequently asked questions, services and prices. Unless expressly stated otherwise (see Article 4), Therago verifies neither their authenticity, nor their accuracy, nor their validity, and cannot be held liable for that content.

A Patient who considers that content accessible on the Platform is unlawful, misleading or contrary to these Terms may report it to contact@therago.be, stating where possible the address of the page concerned, the content in question and the reason for the report. Therago acknowledges receipt, examines it within a reasonable time and informs the person who made the report of the action taken. Manifestly unlawful content may be removed or made inaccessible without delay, without such removal constituting an admission of liability.

Article 7 — Booking, cancellation and no-show

Booking an appointment through the Platform is subject to each Therapist's own cancellation policy, as displayed at the time of booking. The Patient must read this policy before confirming their booking. Any question relating to a cancellation, rescheduling or no-show fees must be addressed directly to the Therapist concerned.

Article 8 — Personal data

The processing of the Patient's personal data in connection with the use of the Platform is described in the privacy policy, which forms an integral part of these Terms. Booking an appointment with a Therapist involves the processing of health data within the meaning of Article 9 GDPR; this processing is based on the Patient's explicit consent, collected at the time of booking.

Article 9 — Therago's liability

Therago's liability is limited to the technical operation of the Platform (matchmaking, appointment booking, notifications). Therago cannot be held liable for the acts, omissions, advice or services of the Therapists, nor for any damage arising from the care relationship. To the extent permitted by law, Therago's total liability towards a Patient is capped at the total amount paid by that Patient to Therago during the last twelve (12) months; as use of the Platform is free of charge for Patients, that amount is in principle zero (0) euros. Nothing in these Terms excludes or limits Therago's liability in the event of fraud, gross negligence or personal injury caused by its fault, nor any mandatory consumer right.

Article 10 — Emergencies

The Platform is not designed for emergency situations. In the event of a medical or psychological emergency, or if you are having suicidal thoughts, immediately call 112 (the European emergency number) or the Suicide Prevention Centre on 0800 32 123 (free of charge, 24/7).

Article 11 — Changes to the Terms

Therago may amend these Terms at any time. The applicable version is the one in force at the time the Platform is used or the booking is made. In the event of a substantial change, renewed acceptance may be requested at the next booking.

Article 12 — Governing law, jurisdiction and mediation

These Terms are governed by Belgian law. Any dispute relating to their validity, interpretation or performance falls within the jurisdiction of the courts of the judicial district of Walloon Brabant, without prejudice to the mandatory jurisdiction rules applicable to consumers. In accordance with Regulation (EU) No 524/2013, consumer Patients may also use the European Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr, or the Belgian Consumer Mediation Service (mediationconsommateur.be).
